Legal Substances in Family Court: Marijuana and Prescription Drugs

Presented by: Adie Rae Wilson-Poe, PhD,  Henry M. Miller, JD, Judge Annette Llewellyn, and Judge Nicole S. Zellweger
The marijuana laws in Missouri have changed.  What once was strictly illegal is now legal in some, and perhaps soon all, circumstances.  How will the courts, family law attorneys and mental health professionals change the way they design parenting plans and think about how marijuana and other prescriptions drugs impact a person’s ability to parent.  We will learn about the current research on prescriptions drugs, including marijuana and discuss crafting parenting plans when a parent uses these substances and how these changes may impact Guardians Ad Litem recommendations.  ​

This event has been approved for 1.5 CU hours for Social Workers; CLEs for attorneys are pending. 

Learning Objectives

Upon completion of this workshop, attendees are expected to:
  • Learn current status and changes to the law for marijuana in Missouri.
  • To understand the research on the impacts of prescription drugs and marijuana on a persons’ ability to parent.
  • To help professionals better understand how to weigh these issues when crafting parenting plans and determine how to best address a change in parenting based on their use of these substances.
  • To learn how a GAL weighs these issues and how it impacts their recommendations to the court.
  • To hear from Family Court judges about decisions for families in regard to these substances.

About the Presenters

Judge Annette Llewellyn was appointed circuit court judge for the 22nd Circuit Court in the City of St. Louis in January 2018.  She is a graduate of Lehman College with a B.S. in accounting and received her J.D. from the University of Iowa. She worked for many years as a public defender before joining the circuit attorney's office. Judge Llewellyn is a member of the New York Bar, the Mound City Bar Association, the Women Lawyers’ Association, and the Lawyers Association of St. Louis.

Dr. Adie Wilson-Poe is Assistant Scientist R.S. at Dow Neuroscience Laboratories. Dr. Wilson-Poe received her BS in Psychology and her PhD in Neuroscience from Washington State University, where she focused on the pain-relieving properties of opioids and cannabinoids. Adie followed up on this training by taking a post-doctoral position at Sydney University in Australia, where she was awarded a National Research Service Award from the National Institute on Drug Abuse (NIDA) to study the synaptic physiology of cannabinoids and opioids. Dr. Wilson-Poe continued her post-doctoral training at Columbia University, where she broadened her expertise to include the dynamic interaction between drug abuse and chronic pain. As a junior faculty member at Washington University in St. Louis, Adie was awarded a prestigious Pathway to Independence Award from NIDA, which integrates all previous facets of her work. Adie joined Legacy Research Institute in June of 2019, and she currently utilizes translational and clinical research approaches to further characterize the analgesic and harm-reducing properties of cannabis, in the context of opioid use.

Nicole S. Zellweger was appointed an Associate Circuit Judge in April 2018, by Governor Eric Greitens. Before her appointment to the bench, Judge Zellweger was a partner with the law firm of Stinson Leonard Street LLP. Her legal practice focused primarily on business litigation with concentration in the areas of franchise law and trust and estate litigation. She graduated from the University of Georgia magna cum laude in December 1999 and received a Master of Arts degree from Yale University Divinity School in 2001. Judge Zellweger attended law school at Washington University in St. Louis, graduating Order of the Coif in 2004. Judge Zellweger is the chair of the trial section of the Bar Association of Metropolitan St. Louis and a board member of the Mound City Bar Foundation. She is also a member of the St. Louis County Bar Association, the Women Lawyers' Association of St. Louis, the Missouri Bar, the Kansas Bar and the Illinois Bar. She is a frequent author and speaker on legal topics, with numerous national publication credits. Among other distinctions, Judge Zellweger was named an "Up & Coming" attorney by Missouri Lawyers Media and has been recognized numerous times as a "Rising Star" by Super Lawyers.

Henry (Hank) M. Miller has expertly represented clients in family law matters for over 20 years, including those with complex assets in high net worth.  He handles any type of Missouri family law related matters, including divorces, paternity cases, child custody, child support, juvenile law (abuse and neglect and delinquency cases), domestic violence, guardianships and adoptions, step-parent adoptions, and LGBTQ issues including the subjects above and name and gender marker changes. Hank also acts as a parent coordinator and serves as a Guardian Ad Litem in divorce cases, representing the best interest of the child. He was selected for inclusion in Super Lawyers, Missouri and Kansas in 2015 and every year since. In addition to Family Law, Hank defends the rights of the accused in state and federal criminal matters, having won acquittals for his clients. He is a member of the prestigious Criminal Justice Act Lead Panel for the Eastern District of Missouri. He is also a member of the St. Louis County Bar Association, the St. Charles County Bar Association, and the Jefferson County Bar Association.
